Reichstag Fire Decree

The Decree of the Reich President for the Protection of People and State, issued by President Hindenburg under Article 48 of the Weimar Constitution on 28 February 1933, the day after the Reichstag fire. It suspended personal liberty, freedom of expression, the press, assembly and association and the privacy of communications, becoming a central legal foundation of the Nazi dictatorship.

In depth

Issued five days before the last election of 5 March, it allowed political opponents to be held in “protective custody” without specific charges, opposition newspapers and meetings to be banned and the central government to take over the powers of the states. Communist officials were arrested en masse during the campaign, and the first concentration camps, Dachau among them, were set up on its authority. Though formally temporary, it was never repealed until 1945.
