Declaration of the Rights of the Working and Exploited People

A constitutional declaration of Soviet Russia drafted by Lenin and adopted by the Third All-Russia Congress of Soviets in January 1918. When the Constituent Assembly refused to adopt the Declaration, the Bolsheviks and Left SRs walked out and the Assembly was dissolved. The Declaration abolished private land ownership and made the land the property of the whole people, confirmed workers' control and the Supreme Economic Council, nationalised the banks, instituted universal labour conscription, and decreed a socialist Red Army with the disarming of the propertied classes. Its fourth section excluded the exploiting classes from governing and left each nation to decide on federal participation, and it was later incorporated as Part One of the 1918 RSFSR Constitution.

Structure and Content

The adopted Declaration comprised four sections. The first established the political foundations of the Soviet state and the federal principle; the second set the basic task of building socialism and provided for land socialisation, workers' control and bank nationalisation, universal labour conscription, and the creation of a Red Army. The third set out foreign-policy principles: peace, the annulment of secret treaties and of foreign loans, and self-determination including Finland and Armenia. The fourth excluded the exploiting classes from governing the Soviet state while providing that the workers and peasants of each nation could independently decide at their own congress on participation in the federal government and other federal Soviet institutions.

On the economic side, the Declaration abolished private land ownership, declared the entire land fund the property of the people and transferred it to the working people without redemption on egalitarian principles, and nationalised forests, subsoil, waters of state importance, model estates and agricultural enterprises. Confirmation of workers' control and the Supreme Economic Council was framed as the first step toward the complete transfer of factories, mines, railways and other means of production and transport to the Soviet Republic, and the annulment of tsarist, landlord and bourgeois loans was regarded as a first blow at international banking capital. The Declaration was to be published immediately and read from the Constituent Assembly rostrum by the official representative of Soviet power opening it.

Conflict with the Constituent Assembly and Adoption by the Third Congress

The Declaration was drafted amid severe crisis after the First World War and social upheaval. The Bolsheviks claimed to hold power only until the Constituent Assembly convened, and the draft written by Lenin was approved by the All-Russian Central Executive Committee on 3 (16) January in order to obtain the Assembly's endorsement. The SR majority found its demands unacceptable. On 5 (18) January Sverdlov read the Declaration out on behalf of the Bolshevik faction, but the Assembly did not take it up. The Bolsheviks and then the Left SRs walked out, depriving the sitting of a quorum; the remaining deputies adopted ten points of a land law, and the next day the doors were closed and the Assembly was dissolved.

Sources differ over precisely how the Assembly disposed of the Declaration: the Russian Wikipedia article states that it was rejected by 237 votes to 136, while other accounts, including a later passage in the same article and other legal sources, say the Assembly refused even to discuss it and did not place the question on its agenda. Either way, the Assembly did not adopt the Declaration, and it was dissolved as a result.

After the dissolution, the question of the constitutional order passed to the Third Congress of Soviets, which opened on 10 (23) January and whose delegates mostly belonged to or supported the Bolshevik party. On 12 (25) January the Congress definitively adopted the Declaration, making it the provisional constitutional document of the Soviet republic, and after the workers' and soldiers' congress merged with the peasants' congress the merged congress again put it to a vote on 18 (31) January and adopted it unanimously. The text was published on 17 January 1918 in Pravda No. 2 and on 31 January 1918 in Izvestia TsIK No. 2.

Incorporation into the Constitution and Significance

On Lenin's proposal the Declaration was included in the Constitution of the Russian Socialist Federative Soviet Republic adopted by the Fifth All-Russia Congress of Soviets on 10 July 1918 as its introductory part, and the two together formed the single fundamental law of the RSFSR. In that constitution the Declaration's provisions appear as Articles 1 to 8, including the abolition of private land ownership, confirmation of workers' control and the Supreme Economic Council, the annulment of tsarist, landlord and bourgeois loans, the creation of a socialist Red Army and the disarming of the propertied classes, the foreign-policy chapter, and the exclusion of exploiters from government agencies together with the free federation of Soviet republics.

In Soviet legal commentary the Declaration was treated as a constitutional rather than purely programmatic document: a detailed reading concludes that it legally fixed what had already been achieved in practice. Stalin's contemporaneous characterisation placed it in the transitional period from capitalism to socialism, defined by the suppression of the overthrown classes and defence against external attack as the two basic functions. The Declaration did not establish concrete forms of federation, and it served as a prototype of the future constitution, with its provisions carried into the legal systems of the USSR and the union republics until 1991.

Titles and Distinctions

The document circulates in English under several titles. Besides the standard rendering, a separate translation under the title 'Declaration of the Rights of the Toiling and Exploited Peoples' shows that the same document is cited with different standard English titles and section structure.

The Declaration is distinct from the Declaration of the Rights of the Peoples of Russia, issued on 15 November (Old Style) 1917. The former is a constitutional document defining the constitutional order and the social and economic tasks of the Soviet state, whereas the latter proclaimed the equality and self-determination of nations; the Declaration itself likewise contained clauses recognising Finland's complete independence, the beginning of the withdrawal of troops from Persia, and self-determination for Armenia.

The 1918 Constitution of the RSFSR제1부 근로 피착취 인민의 권리 선언

제1장

제1조. 러시아는 노동자·병사·농민 대표 소비에트의 공화국임을 선언한다. 중앙과 지방의 모든 권력은 이 소비에트들에 속한다.

제2조. 소비에트 러시아 공화국은 자유로운 민족들의 자유로운 연합에 기초하여 소비에트 민족 공화국들의 연방으로 수립된다.

제2장

제3조. 인간에 의한 인간의 모든 착취의 근절, 사회의 계급 분열의 완전한 철폐, 착취자에 대한 가차 없는 진압, 사회의 사회주의적 조직의 수립과 모든 나라에서의 사회주의의 승리를 자기의 기본 임무로 삼으면서, 제3차 전러시아 노동자·병사·농민 대표 소비에트 대회는 나아가 다음과 같이 결정한다.

  • a) 토지의 사회화를 실현하기 위하여 토지에 대한 사적 소유는 폐지되며, 모든 토지는 전 인민의 재산으로 선언되고 아무런 배상 없이 균등한 토지 이용의 원칙에 따라 근로자에게 넘겨진다.
  • b) 전국가적 의의를 가지는 모든 삼림, 지하자원과 수역, 그리고 모든 생축과 농기구, 모범 영지와 농업 기업은 국민의 재산으로 선언된다.
  • c) 공장, 제조소, 광산, 철도 및 그 밖의 생산수단과 운수 수단이 소비에트 노농 공화국의 소유로 완전히 이행하는 첫걸음으로서, 착취자에 대한 근로자의 권력을 보장하기 위하여 노동자 통제와 최고국민경제회의에 관한 소비에트 법률을 확인한다.
  • d) 제3차 소비에트 대회는 차르, 지주, 부르주아지의 정부가 체결한 차관의 무효화(폐기)에 관한 소비에트 법률을 국제 은행·금융 자본에 대한 첫 타격으로 간주하며, 소비에트 권력이 자본의 멍에에 맞선 국제 노동자 봉기의 완전한 승리에 이르기까지 이 길을 확고히 걸어가리라는 확신을 표명한다.
  • e) 자본의 멍에로부터 근로 대중을 해방하기 위한 조건의 하나로서, 모든 은행이 노농 국가의 소유로 이행함을 확인한다.
  • f) 사회의 기생적 계층을 일소하고 경제를 조직하기 위하여 일반 노동 의무를 도입한다.
  • g) 근로 대중에게 권력의 전 권능을 보장하고 착취자 권력의 부활 가능성을 일절 제거하기 위하여, 근로자의 무장, 노동자와 농민의 사회주의적 붉은 군대의 창설, 유산 계급의 완전한 무장 해제를 법령으로 정한다.

제4조. 현재의 모든 전쟁 중 가장 범죄적인 이 전쟁으로 대지를 피로 물들인 금융 자본과 제국주의의 마수로부터 인류를 구출하려는 불굴의 결의를 표명하면서, 제3차 소비에트 대회는 소비에트 권력이 수행하는 정책, 곧 비밀 조약을 파기하고, 현재 서로 싸우고 있는 군대의 노동자·농민 사이에 가장 광범한 형제적 친교를 조직하며, 병합도 배상도 없는, 민족의 자유로운 자결에 기초한 근로자의 민주주의적 평화를 혁명적 수단으로 기어이 달성하는 정책에 전적으로 찬동한다.

제5조. 같은 목적에서 제3차 소비에트 대회는, 소수의 선택된 민족에서 착취자의 번영을 아시아와 식민지 일반과 약소국의 수억 근로 인민의 노예화 위에 쌓아 올린 부르주아 문명의 야만적 정책과의 완전한 단절을 주장한다.

제6조. 제3차 소비에트 대회는 핀란드의 완전한 독립을 선포하고, 페르시아로부터의 철군을 개시하였으며, 아르메니아의 자결의 자유를 선언한 인민위원회의의 정책을 환영한다.

제4장

제7조. 제3차 전러시아 노동자·병사·농민 대표 소비에트 대회는, 프롤레타리아트가 자기의 착취자들과 결정적 투쟁을 벌이는 지금 이 순간, 착취자는 그 어떤 권력 기관에도 자리를 차지할 수 없다고 본다. 권력은 전적으로 그리고 오로지 근로 대중과 그 전권 대표 기관인 노동자·병사·농민 대표 소비에트에 속하여야 한다.

제8조. 아울러 러시아의 모든 민족의 근로 계급의 진정으로 자유롭고 자발적인, 따라서 그만큼 더 완전하고 공고한 연합을 창설하고자 노력하면서, 제3차 소비에트 대회는 러시아 소비에트 공화국들의 연방의 근본 원칙을 확립하는 데 그치고, 각 민족의 노동자와 농민이 연방 정부와 그 밖의 연방 소비에트 기관에 참가하기를 원하는지, 또 어떤 기초 위에서 참가할 것인지를 자기 민족의 전권 있는 소비에트 대회에서 스스로 결정하도록 맡긴다.
