사회권
social rights
사회권은 국가가 모든 사람의 노동, 사회보장, 건강, 교육, 주거와 적절한 생활수준을 보장하고 증진해야 한다는 경제·사회적 권리의 총칭이다. 노동 영역에서는 유급휴가, 단체교섭, 노동자 대표와 결사의 권리처럼 개인의 권리와 집단적 권리를 함께 포함한다.

사회권은 자유권과 대비되는 권리로만 이해할 수 없으며, 법률·행정·재정 조치를 통한 국가의 적극적 이행을 요구한다. 국제적으로는 1948년 세계인권선언의 사회보장·노동·휴식·생활수준 조항과 1966년 경제적·사회적·문화적 권리에 관한 국제규약에 의해 체계화되었다. 프랑스 인민전선 시기의 유급휴가와 단체협약은 사회권이 노동운동의 집단적 투쟁과 입법을 통해 제도화되는 사례다.
